Prenuptial agreements are a tool used to allow parties entering into a marriage the ability to determine the division of assets and property prior to a marriage, in the event of death or dissolution.

Prenuptial agreements permit parties to deviate from the New York divorce laws, make their own decisions regarding their own lives, and allows parties to do so well in advance of any fighting, arguing, or derogatory feelings. Furthermore, prenuptial agreements do not become enforceable until there is a death or dissolution of the marriage. They are simply meant to protect the parties just in case the document becomes necessary.
